Review the immigration case and the investment

An EB-5 preparation guide covering the enterprise, lawful source of funds, job creation, project questions and the distinction between immigration and investment risk.

The starting point

An EB-5 proposal needs two separate reviews: whether the immigration requirements can be met and whether the investment makes financial sense. Neither review substitutes for the other.

Understand what the classification requires

EB-5 connects qualifying capital investment in a new commercial enterprise with job creation. USCIS generally requires at least ten qualifying full-time positions. Direct and regional-center investments use different job-counting rules.

For petitions filed under the current post-March 2022 framework, the USCIS overview lists a standard minimum of $1,050,000 and $800,000 for qualifying targeted-employment-area or infrastructure investments. These figures are not a quote for the full cost of a case; verify the filing-date rules and future adjustments before committing funds.

Trace funds from origin to investment

Start a chronological record of how the investment funds were earned or acquired and how they moved. A current bank balance does not explain the origin of the money or the path between accounts.

  • Identify each source, transfer and currency conversion.
  • Keep the supporting records for each step together.
  • Flag gifts, loans, sales or business distributions for professional review.
  • Explain gaps in the record rather than replacing them with assumptions.

Ask your adviser which evidence is required for the particular source and jurisdiction. Avoid sending sensitive financial records to a project promoter before understanding the recipient and purpose.

Examine the project’s claims

Ask how the project expects to meet the job requirement, what documents support the explanation and who will monitor progress. Distinguish a project’s sales presentation from independent legal and financial analysis. USCIS designation or an immigration filing is not a guarantee of investment performance.

Separate the milestones

Capital transfer, a petition decision, visa availability, residence and removal of conditions are different milestones. Ask for a written explanation of which event each proposed date refers to. A promised completion date should not be treated as an agency commitment.

Track immigration costs separately from investment capital, administrative charges and professional fees. Read the current USCIS fee schedule and applicable form instructions before payment; fee rules can change while a project is being considered.

Use independent professional review

Before signing, ask about loss of capital, delays, conflicts of interest, withdrawal terms and what happens if immigration plans change. Immigration counsel, financial advisers and tax advisers answer different questions. Clarify who represents you and who is paid by the project.

This guide is a preparation framework, not an investment recommendation or a finding that a project qualifies for EB-5.
